Deposit, Cancellation, and Refund Policy

Quote Validity Period:
- Each quotation remains valid for a period of 3 days from the date of issuance unless otherwise stated on the official quotation document. Receiving a quote does not guarantee your date is secure in our calendar. Please be aware that other customers may secure your selected date during this time. If you are undecided about your quote yet still wish to secure your date, you can request to pay a non-refundable Calendar fee of $150 that will be credited to your invoice upon final confirmation of a design.

Booking Confirmation:
- Upon finalising the basic size and design specifications of your cake and proceeding with your order, a non-refundable deposit of 50% is required, or payment in full if your cake is due within 30 days of issuance of your quote. Your booking is considered confirmed only upon the receipt of the required payment.

Payment Details:
- The remaining balance for your order must be settled in full at least 30 days prior to your cake's required date. Payment can be made either in cash or via direct deposit, with instructions provided in your invoice.

Late Payments:
- Failure to make payments by the due date MAY result in the cancellation of your order. Please contact us immediately to discuss any payment issues.

Cancellation with More Than 7 Days Notice:
- If you need to cancel with more than 7 days' notice, all cancellation requests must be made in writing. If you wish to postpone your event, please contact us immediately. We will attempt to accommodate your new date if available, and all funds paid will be transferred to the new date without penalty. If the new date is unavailable, please refer to the below cancellation policy.

If you must cancel your order, the refund policy is as follows:
- Cash refunds are not provided.
- A credit voucher will be issued for any amount paid beyond the non-refundable 50% deposit. These vouchers are valid for 12 months from the original event date and can be used for new or existing orders (not applicable to booking deposits).
- If we are unable to fulfill your order due to unforeseen circumstances (e.g., accident or illness), your deposit will be refunded in full, and we will assist you in finding an alternative decorator.

Cancellation with Less Than 7 Days Notice:
- If you cancel with less than 7 days' notice, the full amount of your cake is payable, and no refund or credit will be provided.
Design and Flavor Changes :
- Minor design changes are accepted after a deposit is received up to 4 weeks before your event. Flavor changes may be accepted up to 2 weeks prior to your event, subject to availability at Mystery Bay Bakehouse discretion. Changes may lead to adjustments in the quote, and an administration fee may be charged. All changes are subject to viability and quote review.

Allergies:
- Mystery Bay Bakehouse is not responsible for allergy-related issues. Unless specified otherwise on your order, all products may contain or come into contact with dairy, wheat, nuts, soy, and other allergens. It is the client's responsibility to inform their guests of any risks.

Setup and Delivery:
- Setup and delivery are available for certain cakes, subject to Mystery Bay Bakehouse discretion. Charges may apply and depend on the venue's location. Adequate access to the venue, such as parking and lift access, is necessary. Cake pickup arrangements can be made from Monday to Saturday. If you or your representative choose to pick up and set up the cake, you assume responsibility for its handling once it leaves our possession. While we take care in boxing your cake, cakes transported by you are at your own risk.

Storage:
- For fondant-covered cakes or those with sugar paste decorations, refrigeration is not recommended to prevent icing condensation. These items should be stored in a cool, dry place, away from direct sunlight and heat. Buttercream cakes can be refrigerated, but they should also be stored in a cool, dry place, away from direct sunlight and heat.

Non-Guarantee:
- Mystery Bay Bakehouse is not responsible for any damage to the cake or products once they are delivered or in the client's or venue's care. When clients choose to self-transport, we are not liable for any transportation-related damage.

Photo Usage:
- Mystery Bay Bakehouse retains the right to use any photos taken of your creation for media-related activities, including publication on our website, social media, or advertising.

Your Consent:
- By placing an order and paying the non-refundable deposit, you agree to the terms and conditions outlined above.

eGift Cards:
Gift cards are valid for 3 years from the date of purchase and can be redeemed for products of equivalent value at Mystery Bay Bakehouse. They are non-refundable, cannot be exchanged for cash, and any unused balance will not be refunded. They cannot be used in conjunction with any other offer. Mystery Bay Bakehouse reserves the right to amend these terms and conditions at any time

Mothers Day Giveaway
Terms & Conditions

1. The prize consists of a Fancy Top Cake valued at $185.
2. Entries for the giveaway close on Saturday, May 11th, 2024, at 12:00 AM (local time).
3. The winner will be randomly drawn and announced on Sunday, May 12th, 2024, at 12:00 PM (local time).
4. The prize will be valid for 12 months from the date of issuance.
5. The winner will be notified via email within 24 hours of the draw. If the winner does not respond within 48 hours of being contacted, another winner will be selected.
6. The prize is non-transferable and cannot be exchanged for cash or other services.
7. This giveaway is open to individuals residing in townships between Bermagui and Dalmeny.
8. Mystery Bay Bakehouse reserves the right to disqualify entries that are incomplete, illegible, or fraudulent.
9. By participating in this giveaway, entrants grant permission for their name and likeness to be used for promotional purposes related to the giveaway.
10. Personal information collected during the giveaway will be used solely for the purpose of administering the giveaway and will not be shared with third parties.
11. Participants agree to receive promotional material from Mystery Bay Bakehouse such as newsletters, event updates, and special offers.
12. Participants reserve the right to unsubscribe from receiving promotional material from Mystery Bay Bakehouse at any time.
13. Entrants agree to abide by these terms and conditions and Mystery Bay Bakehouse's decisions, which are final and binding in all matters related to the giveaway.
14. This giveaway is not sponsored, endorsed, administered by, or associated with Facebook or any other social media platform.
15. Mystery Bay Bakehouse reserves the right to modify, suspend, or terminate the giveaway at any time without prior notice.

a) We may collect Personal Information from you whenever you input such information into the Website, related app or provide it to Us in any other way.

c ) We generally don’t collect Sensitive Information, but when we do, we will comply with the preceding paragraph.
d) Where reasonable and practicable we collect your Personal Information from you only. However, sometimes we may be given information from a third party, in cases like this we will take steps to make you aware of the information that was provided by a third party.
4. Purpose of collection
a) We collect Personal Information to provide you with the best service experience possible on the Website and keep in touch with you about developments in our business.
b) We customarily only disclose Personal Information to our service providers who assist us in operating the Website. Your Personal Information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.
c) By using our Website, you consent to the receipt of direct marketing material. We will only use your Personal Information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from use. We do not use sensitive Personal Information in direct marketing activity. Most of the Personal Information that is stored in our client files and records will be kept for a maximum of 7 years to fulfill our record keeping obligations.

(i) permit you to obtain access to the Personal Information we hold about you in certain circumstances (Australian Privacy Principle 12); and
(ii) allow you to correct inaccurate Personal Information subject to certain exceptions (Australian Privacy Principle 13).

6. Complaint procedure
If you have a complaint concerning the manner in which we maintain the privacy of your Personal Information, please contact us as on the contact details set out at the bottom of this policy. All complaints will be considered by Rachel Love and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.
7. Overseas transfer
Your Personal Information may be transferred to recipients located in the EU. EU has data protection laws which protect Personal Information in a way which is at least substantially similar to the Australian Privacy Principles, and there will be mechanisms available to you to enforce protection of your Personal Information under that overseas law. In the circumstances, we do not require the overseas recipients to comply with the Australian Privacy Principles and we will not be liable for a breach of the Australian Privacy Principles if your Personal Information is mishandled.
